Probate - Estate and Protective Proceedings

The word "probate" is often associated with negative meanings. Finding yourself or a family member in a probate proceeding can be stressful, especially without proper advice and guidance. Our practice at Shelley L. Fuller & Associates is to provide meaningful advice and guidance about how to navigate the Oregon courts' probate departments.

Probate is probably best known as the process of administering an estate. If you have been nominated as personal representative by a will, our firm will assist you in admitting the will and the underlying estate to probate, making sure the proper documents are filed, and providing an inventory and accounting to the court. Our firm can also assist in probating a family member's estate if that person has died without a will or "intestate." We will help you navigate your way through the unfamiliar system and make sure you understand your roles and duties as a fiduciary.

Probate also encompasses Guardianship and Conservatorship proceedings. These proceedings are called "protective proceedings" and are initiated to help provide assistance to individuals that may not be able to care for or make decisions for themselves. These types of proceedings can include matters regarding minor children as well as adults. We can help you determine if it is the appropriate time to initiate such a proceeding against a family member who may be suffering from some sort of diminished capacity. We can also assist individuals who are the "Respondent" or person someone has proposed to a court needs protecting in such matters, and help protect their individual rights during this type of proceeding.

It is always difficult to determine if a close family member is suffering from some incapacity and may not be able to make appropriate decisions regarding their health or finances. A time of loss can also be a difficult time to handle the administration of an estate. At Shelley L. Fuller & Associates, we recognize the emotional nature of these proceedings and will strive to provide the necessary guidance and advice to help you and your family through any estate and/or protective proceedings.
